Please note in these unprecedented times our priority is to act with empathy and compassion, so we will review each postponement or cancellation on a case by case basis. We will do our absolute best to reschedule any weddings affected by COVID-19 with understanding.
Force Majeure Events:
If we cannot perform or believe we may not be able to perform our Agreement in whole or in part due to a fire, natural disaster, act of war or terrorism (domestic or foreign), epidemic or pandemic (including COVID-19), action of any Governmental authority, national or regional emergency, other casualty, act of God, or other cause beyond our control, or due to Holii & Ash illness or injury, whether or not foreseeable (“Force Majeure Event”), then we will give notice to our clients as soon as reasonably practicable.
Holii & Ash work to maintain a safe work environment, including but not limited to, complying with applicable Governmental laws, directives, orders, and regulations (each a “Governmental Order”). Holii & Ash shall not be required to perform if the Event is held in violation of a Governmental Order or if Holii & Ash participation in the Event would violate a Governmental Order. We are not obligated to continue to perform if our personal safety or well-being has been or will be compromised or threatened at the Event, including, but not limited to, as a result of the condition of the venue for the Event, or the conduct of an attendee of the Event.
Vaccinations & Illness:
Holii & Ash are double/triple vaccinated against Covid-19 and are able to provide proof upon request. If Holii & Ash are required to isolate due to contracting the virus or being a close contact – preventing them from attending the Event, we will do our utmost to find a replacement associate Photographer or Videographer. The replacement will shoot the wedding on our behalf and we will edit the photos / video in our own signature aesthetic. If we are unable to find a suitable replacement we will notify the Clients as soon as possible.
Postponement & cancellation due to Force Majeure Events where a Government order prevents the wedding from going ahead:
In case of the above, we will contact our Clients to find an alternative date for the Event that is suitable to both the Clients and Holii & Ash, without penalty. If Clients contract Covid-19 and required to isolate – we recognise this as a Government order preventing the wedding from going ahead.
To the extent the Parties cannot agree on a suitable replacement date consistent with Holii & Ash availability, we will cancel the Event and return any fees paid minus the non-refundable retainer, which is paid to secure a date and cover admin expenses.
In the case of a Force Majeure Event that prevents Holii & Ash from performing but does not otherwise impact the Event, including, but not limited to, illness or injury to Holii & Ash, we shall make reasonable efforts to suggest a replacement photographer for the Event. Should the Clients not accept a replacement photographer selected by Holii & Ash to perform our obligations under the Agreement, we shall refund monies paid by the Client, excluding the non-refundable retainer.
Postponement due to impacts of Covid-19 or Force Majeure Events including guests from interstate not being able to attend due to border closures, and Clients being unvaccinated:
In the case that the Client requests a date change because of guests not being able to attend because of border closures, restrictions because the Clients are unvaccinated, or other impacts from Covid-19 that don’t include a Government order preventing the wedding from going ahead, the following conditions apply:
• The wedding must be scheduled within 12 months of the original date.
• 50% of the non-refundable retainer will carry over and the Client will pay the other 50% to hold another date.
• The new wedding date must be scheduled for a weekday or a Sunday.
• Any booking upgrades or date changes will be subject to updated Holii & Ash packages and increased prices.
• The Clients must sign a new contract
Cancellation due to any other reason – including guests from interstate not being able to attend due to border closures and Clients being unvaccinated:
In the event that the Client cancels the services booked within 6 months of the Event date the Client must agree to pay the package in full, due to Holii & Ash forgoing the opportunity to book another event in this time frame. Any monies paid to Holii & Ash in this case is non-refundable. If the wedding date is beyond 6 months, we will cancel the Event and return any fees paid minus the non-refundable retainer, which is paid to secure a date and cover admin expenses.
